These terms govern your use of pacificechelon.com and related services (the "Site") operated by Pacific Echelon ("we", "us"). By using the Site you agree to them. If you do not agree, do not use the Site. Security services we provide to customers are governed by separate written agreements.

1. Eligibility and accounts

You must be at least 18 and use the Site for business purposes. Provide accurate information and keep your sign-in methods secure. You are responsible for activity under your account. You can delete your account at any time from the welcome page.

2. Acceptable use

• Do not attempt to access data or systems you are not authorized to access.
• Do not probe, scan or test the vulnerability of the Site, or bypass rate limits or the bot check.
• Do not use automation to create accounts or send inquiries in bulk.
• Do not upload malicious code or interfere with the Site's operation.
• Do not use the Site to violate any law or third-party right.

We may suspend or terminate access for violations or to protect the Site.

3. Content and intellectual property

The Site, its text, design and software are owned by us or our licensors and are protected by law. We grant you a limited, revocable, non-transferable right to use the Site for its intended purpose. Information you submit remains yours; you give us permission to use it to respond to you and operate the Site as described in the Privacy Policy.

4. Informational content

Blog posts and other content are general information, not security, legal or professional advice. Use of the Site does not create a security services relationship. Such a relationship exists only under a signed agreement.

5. Third-party services

Sign-in with Google or Apple and the Cloudflare bot check are provided by third parties under their own terms. We are not responsible for them.

6. Disclaimer

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PACIFIC ECHELON WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).

8. Indemnity

You will indemnify us against third-party claims arising from your misuse of the Site or breach of these terms.

9. Governing law and disputes

These terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Multnomah County, Oregon, and you consent to their jurisdiction. Before filing a claim, each party will try to resolve the dispute informally by written notice for at least 30 days.

10. Changes and termination

We may change these terms or the Site. Material changes will be posted here with a new effective date; continued use means you accept them. You may stop using the Site at any time.
